These Terms of Use ("Terms") govern your access to and use of Infinity AI's websites and services, including Infinity AI Solutions, Infinity AI Quick Launch, and Infinity AI Workforce (together, the "Services"), provided by Infinity AI ("Infinity AI," "we," "us," or "our"). By accessing or using the Services, you agree to these Terms. If you don't agree, don't use the Services.

The Services

Infinity AI provides website design and launch services (Quick Launch), business consulting and implementation (Solutions), and an AI business-assistant platform (Workforce) that can answer calls, respond to chats and messages, manage leads, and schedule appointments on behalf of your business. Features vary by plan and may be added, changed, or discontinued over time.

Accounts

You must provide accurate information when creating an account and are responsible for activity that occurs under your account. You must be at least 18 years old and using the Services for a legitimate business purpose.

Subscriptions & Billing

Workforce plans are billed on a recurring subscription basis; Quick Launch engagements are billed based on project scope, as agreed with you before work begins. Payments are processed by our payment processor, Stripe. Subscriptions renew automatically until cancelled. You can cancel at any time from your dashboard or by contacting us; cancellation takes effect at the end of the current billing period unless otherwise stated.

AI-Generated Content

Workforce uses AI to draft and, depending on your plan and settings, automatically send messages, answer calls, and take actions like scheduling on your behalf. AI output can be inaccurate or unexpected. You are responsible for configuring your business profile and settings appropriately, and for reviewing AI-drafted content where your plan requires approval before sending. We are not responsible for decisions made or actions taken based on AI-generated content.

Acceptable Use

You agree not to use the Services to:

• Violate any applicable law or regulation, including telemarketing, SMS, and robocall laws.
• Send unsolicited, deceptive, or harassing communications to any person.
• Interfere with or disrupt the integrity or performance of the Services.
• Attempt to gain unauthorized access to the Services or related systems.
• Use the Services to collect or process data you do not have the right to process.

Third-Party Services

The Services integrate with third-party providers such as Google (Calendar), Twilio (calls and SMS), OpenAI (AI generation), Resend (email), and Stripe (payments). Your use of those integrations is also subject to the relevant provider's own terms. See our Privacy Policy for how we handle data shared with these providers.

Service Availability

We work to keep the Services available and reliable, but they are provided on an "as is" and "as available" basis. Features may be updated, changed, or occasionally unavailable, including during maintenance or due to issues with third-party providers we depend on.

Intellectual Property

We own the Services, including our software, designs, and branding. You retain ownership of the content and business data you provide to us. You grant us a license to use that content solely to provide the Services to you.

Termination

You may stop using the Services and cancel your subscription at any time. We may suspend or terminate access to the Services if you violate these Terms or if required to prevent harm to us, other users, or third parties.

Disclaimer of Warranties

The Services are provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, Infinity AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of the Services.

Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date above when we do. Continued use of the Services after changes take effect means you accept the updated Terms.
